TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of stayliftd.com, shop.stayliftd.com, and any related services (together, the "Site"), and any purchase you make from LIFTD ("LIFTD," "we," "our," or "us"). By using the Site or placing an order, you agree to these Terms, our Privacy Policy, our Shipping Policy, and our Return & Refund Policy, which are part of these Terms.

If you do not agree to these Terms, do not use the Site or purchase our products.

The Site and our products are intended only for adults 21 years of age or older. By using the Site you represent that you are at least 21. We may verify your age at any point, including at checkout and at delivery, and we may refuse or cancel any order we cannot verify.

You agree not to purchase LIFTD on behalf of, resell it to, or share it with anyone under 21. Doing so may be illegal and will result in cancellation of your orders.

LIFTD beverages contain hemp-derived THC and CBG produced from hemp as defined under federal law. Each batch is tested by an independent third-party laboratory, and results are published on our Lab Results page.

State and local laws regarding hemp-derived THC products vary and change frequently. You are solely responsible for knowing and complying with the laws that apply where you purchase, receive, possess, and consume our products. We may refuse to sell or ship to any location at our discretion.

Our products contain THC and can cause impairment. By purchasing or consuming them, you acknowledge the following:

• Do not drive, operate machinery, or engage in hazardous activities after use.
• Do not use if you are pregnant, may become pregnant, or are breastfeeding.
• Consult a healthcare provider before use if you take medication or have a medical condition. THC may interact with certain medications.
• Consuming THC may cause a positive result on a drug test.
• Effects vary by person. Start low, go slow, and do not mix with alcohol.
• Keep out of reach of children and pets.

Statements on the Site have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease. Content on the Site, including our blog and FAQ, is for general information only and is not medical or legal advice.

Placing an order is an offer to buy. We may accept, limit, or cancel any order, including for suspected fraud, resale, ineligible shipping destinations, failed age verification, or pricing and product errors. If we cancel an order after you have been charged, we will refund the amount charged for the canceled items.

Prices are listed in U.S. dollars and may change at any time without notice. Sales tax, where applicable, and shipping charges are shown at checkout. Product images and descriptions are as accurate as we can make them, but packaging and colors may vary. We may limit quantities per customer or per order.

Checkout is processed by Shopify and its payment partners. By submitting payment, you represent that you are authorized to use the payment method and you authorize us to charge it for your order, including applicable taxes and shipping. Your payment information is handled under Shopify's terms and our Privacy Policy.

Shipping is governed by our Shipping Policy. Title and risk of loss pass to you when your order is delivered to the carrier, but we will still help with lost or damaged shipments as described in our Return & Refund Policy. Because our products are consumable, all sales are final except as stated in that policy.

If you create an account, you are responsible for keeping your login credentials secure and for all activity under your account. Provide accurate information and keep it up to date.

If you sign up for emails, we may send you marketing messages. You can unsubscribe at any time using the link in any email. We will still send transactional messages about your orders.

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms.
• Misrepresent your age or identity, or use another person's payment method without permission.
• Buy products for resale without a wholesale agreement with us.
• Interfere with the Site's security or operation, including by scraping, introducing malware, or attempting unauthorized access.
• Submit false, misleading, infringing, or abusive content through our forms.

The LIFTD name, logos, can designs, flavor names, text, graphics, photos, and other content on the Site are owned by or licensed to LIFTD and are protected by intellectual property laws. You may view and share Site content for personal, non-commercial purposes. Any other use requires our prior written permission.

If you send us ideas, feedback, reviews, or other submissions, you grant us a non-exclusive, royalty-free, perpetual license to use them for any purpose without compensation to you. Please do not send confidential information through our contact or wholesale forms.

The Site links to and relies on third-party services, including Shopify, payment processors, carriers, maps, and retailer listings. We are not responsible for third-party content, products, or policies. Retailer listings on our Where to Buy page are provided for convenience; availability and pricing are set by each retailer.

EXCEPT AS EXPRESSLY STATED IN THESE TERMS, THE SITE AND OUR PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY PRODUCT WILL PRODUCE A PARTICULAR EFFECT. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

TO THE FULLEST EXTENT PERMITTED BY LAW, LIFTD AND ITS OWNERS, MANUFACTURERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR OUR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO AN ORDER WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT ORDER. Nothing in these Terms limits liability that cannot be limited under applicable law.

You agree to indemnify and hold harmless LIFTD and its owners, manufacturers, employees, and agents from any claims, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or of any law, including providing our products to anyone under 21 or transporting them into a jurisdiction where they are not permitted.

These Terms are governed by the laws of the State of Connecticut, without regard to its conflict-of-law rules. Before filing a claim, you agree to contact us and try to resolve the dispute informally for at least 30 days. Any claim that is not resolved informally will be brought exclusively in the state or federal courts located in Connecticut, and you consent to their jurisdiction, except that either party may bring an individual claim in small claims court where eligible.

We may update these Terms from time to time. The "Last updated" date at the top of this page shows when they last changed. Changes apply to orders placed and use of the Site after they are posted. If any provision of these Terms is found unenforceable, the rest remain in effect.
